Terms for Drivers

By signing in to your Manjano driver account, you agree to these Terms.

  1. Relationship. Manjano gives you a software tool to share trip and location data with your employer (the school or transport operator) and with authorised parents. Manjano is not your employer, does not engage you, and does not pay, direct, or supervise your work. Your employment or engagement is solely with the school or transport operator that assigned you this account.
  2. Your responsibilities. You agree to
    (a) hold and maintain a valid Kenyan driving licence and all permits required to operate the vehicle;
    (b) drive lawfully and safely and comply with all traffic and public-service-vehicle rules;
    (c) keep your login confidential and use the app only for your assigned trips; and
    (d) never interact with the device while the vehicle is in motion. We recommend for you to have an assistant or conductor who should be the one to operate the device while you are in motion.
  3. Location tracking consent. You understand and consent that, while you are on an active trip, the app collects and shares the vehicle's real-time location and trip status with your employer and authorised parents. This is a core function of the Service and a condition of using the driver account.
  4. Accuracy. You agree to start, update, and end trips honestly and promptly, and not to falsify location, attendance, or trip data.
  5. No liability for driving. Manjano supplies software only. Manjano is not responsible for your driving, the vehicle's condition, route decisions, accidents, injuries, delays, or any incident during transport. Responsibility for safe operation of the vehicle and passengers rests with you and your employer.
  6. Limitation of liability. To the fullest extent permitted by law, Manjano is not liable to you for any indirect, consequential, or employment-related loss, or for anything arising from your driving, the vehicle, or the transport service. Nothing in these Terms excludes liability that cannot be excluded by Kenyan law.
  7. Indemnity. You agree to hold Manjano harmless against claims arising from your driving, your breach of law, or your misuse of the Service.
  8. Suspension. We may suspend or disable your account at your employer's request or if we detect misuse, a safety risk, or a security breach.
  9. Governing law. These Terms are governed by the laws of Kenya, and the courts of Kenya have exclusive jurisdiction.

Privacy

  1. Who is responsible for your data. Where a school uses Manjano, the school is the data controller and Manjano is the data processor acting on the school's instructions. Manjano processes personal data to provide the Service and as required by Kenyan law, including the Data Protection Act, 2019.
  2. What we collect.
    • Parents/guardians: name, contact details, your child's headshot picture, name & school, assigned route, and your account activity.
    • Drivers: name, contact details, ID, the account and trips assigned to you, and the vehicle's real-time location while a trip is active.
    • Schools: the student, the parents, the drivers, and vehicle records the school enters, and administrator account details.
    • Everyone: basic technical data needed to run the app securely (such as device and log information).
  3. Why we use it. To show live bus location and trip status to authorised users, send pick-up/drop-off and trip notifications, operate and secure the accounts, and meet legal obligations. We do not sell your personal data.
  4. Who can see it. Location and trip data are shared only with the users authorised for that route — the assigned driver, the relevant school, and the parents of children on that bus. We use trusted service providers (such as secure hosting and mapping) to run the Service; they process data only on our instructions.
  5. Children's data. Data about children is handled only to deliver the transport-tracking service, on the basis of consent obtained by the school and/or the parent/guardian.
  6. How long we keep it. We keep personal data for as long as the account is active and the service relationship continues, and then delete or return it in line with the school's instructions and applicable law.
  7. Security. We use appropriate technical and organisational measures to protect personal data. If a personal-data breach occurs, we act promptly and notify the responsible school and, where required, the Office of the Data Protection Commissioner.
  8. Your rights. Under the Data Protection Act, 2019 you may request access to your personal data, correction of inaccurate data, or deletion, and you may object to or restrict certain processing. Because the school is the data controller, please make requests to your school; Manjano will support the school in responding.
  9. Contact. For privacy questions, contact your school's administrator.
