Terms for Schools

By signing in and using the Manjano school portal, the person accepting these Terms confirms they are authorised to bind the school ("the School"), and the School agrees to these Terms.

  1. The Service. Manjano provides the School with software to manage bus routes, drivers, students, and parent access, and to display live trip and location information. Manjano provides software only and does not provide, operate, or supervise transport. The School (or its appointed transport operator) is solely responsible for the transport service, vehicles, drivers, routes, and the safety and supervision of students.
  2. School responsibilities. The School agrees to
    (a) provide accurate data for students, parents, drivers, routes and vehicles;
    (b) obtain all necessary consents from drivers, parents/guardians and staff for the data processed through Manjano, including children's data;
    (c) vet, licence, insure, and supervise its drivers and vehicles;
    (d) manage which parents and staff are granted access, and promptly advice Manjano to remove access for people who leave; and
    (e) use the Service in line with all applicable laws, including the Data Protection Act, 2019.
  3. Data protection roles. For personal data processed through the Service, the School is the data controller and Manjano acts as a data processor on the School's instructions. Manjano will process such data only to provide the Service and as required by law, will keep it secure, will not appoint another processor without the School's authorisation, and will notify the School without undue delay of any personal-data breach affecting the School's data. The School warrants that it has a lawful basis and all required consents for the data it shares for uploads.
  4. Accuracy & reliance. Location, ETA, and notification data depend on third-party GPS, network, and device factors and may be delayed or unavailable. The School will not represent to parents that Manjano guarantees location accuracy or child safety, and will keep its own safety and supervision procedures independent of the Service.
  5. Fees. The School agrees to pay the fees in its subscription or order. Access may be suspended for non-payment after reasonable notice. Fees are inclusive of any applicable taxes.
  6. Security & acceptable use. The School will keep credentials secure and not misuse, resell, or reverse-engineer the Service.
  7. Limitation of liability. To the fullest extent permitted by law, Manjano is not liable for any loss, injury, delay, damage, claim, or harm arising from
    (a) transport services, vehicles, or drivers;
    (b) the acts or omissions of the School, its staff, drivers, operators, or parents;
    (c) inaccurate, delayed, or unavailable data; or
    (d) the School's breach of its data-protection or consent obligations.
    Manjano is not liable for any indirect, incidental, special, or consequential loss, or loss of profit, data, goodwill, or reputation. Nothing in these Terms excludes liability that cannot be excluded by Kenyan law.
  8. Indemnity. The School agrees to indemnify, defend, and hold Manjano harmless against any claim, penalty, or cost (including reasonable legal fees) brought by any parent, student, driver, employee, regulator, or third party arising from
    (a) the transport service;
    (b) the School's data, instructions, or breach of these Terms; or
    (c) the School's failure to obtain required consents.
  9. No warranty. The Service is provided "as is" and "as available". To the extent permitted by law, Manjano disclaims all implied warranties, including fitness for a particular purpose and uninterrupted availability.
  10. Termination. Either party may terminate as set out in the subscription. On termination, Manjano will, on request, return or delete the School's data in line with applicable law.
  11. Governing law. These Terms are governed by the laws of Kenya, and the courts of Kenya have exclusive jurisdiction.

Privacy

  1. Who is responsible for your data. Where a school uses Manjano, the school is the data controller and Manjano is the data processor acting on the school's instructions. Manjano processes personal data to provide the Service and as required by Kenyan law, including the Data Protection Act, 2019.
  2. What we collect.
    • Parents/guardians: name, contact details, your child's headshot picture, name & school, assigned route, and your account activity.
    • Drivers: name, contact details, ID, the account and trips assigned to you, and the vehicle's real-time location while a trip is active.
    • Schools: the student, the parents, the drivers, and vehicle records the school enters, and administrator account details like contact details, name and email address.
    • Everyone: basic technical data needed to run the app securely (such as device and log information).
  3. Why we use it. To show live bus location and trip status to authorised users, send pick-up/drop-off and trip notifications, operate and secure the accounts, and meet legal obligations. We do not sell your personal data.
  4. Who can see it. Location and trip data are shared only with the users authorised for that route — the assigned driver, the relevant school, and the parents of children on that bus. We use trusted service providers (such as secure hosting and mapping) to run the Service; they process data only on our instructions.
  5. Children's data. Data about children is handled only to deliver the transport-tracking service, on the basis of consent obtained by the school and/or the parent/guardian.
  6. How long we keep it. We keep personal data for as long as the account is active and the service relationship continues, and then delete or return it in line with the school's instructions and applicable law.
  7. Security. We use appropriate technical and organisational measures to protect personal data. If a personal-data breach occurs, we act promptly and notify the responsible school and, where required, the Office of the Data Protection Commissioner.
  8. Your rights. Under the Data Protection Act, 2019 you may request access to your personal data, correction of inaccurate data, or deletion, and you may object to or restrict certain processing. Because the school is the data controller, please make requests to your school; Manjano will support the school in responding.
